Im Fall der Leistungsstorung des Kaufvertrages konzentrieren sich die Interessen der Vertragsparteien auf ihre Rechtsbehelfe. Der Nacherfullungsanspruch hat eine besondere Funktion unter den Rechtsbehelfen des Kaufers, denn mit dessen Hilfe kann der Kaufer verlangen, was er sich vom Kaufvertrag erwartet hat. Im CISG wurde der Nacherfullungsanspruch von Anfang an als Rechtsbehelf konzipiert. Nach der Schuldrechtmodernisierung wurde der Nacherfullungsanspruch im BGB allgemein geregelt, jedoch wird er nach uberwiegender Auffassung lediglich als modifizierter Erfullungsanspruch verstanden. Hwa Kim stellt die Frage nach dem tradierten Verstandnis des Nacherfullungsanspruchs und analysiert diesen insbesondere anhand der jungsten EuGH-Urteile. Daraus ergibt sich, dass der Nacherfullungsanspruch als ein echter Rechtsbehelf des Kaufers zu betrachten ist. Uberdies zeigt der Autor die Problematik des Nacherfullungsanspruchs im koreanischen BGB.
